1. Acceptance of Terms

By accessing and using PassMonitor (passmonitor.com), you agree to these Terms of Use in their entirety. If you do not agree with any provision, you should not use the service. Continued use of PassMonitor after any changes to these terms constitutes acceptance of the updated conditions.

2. Service Description

PassMonitor is a service that allows you to check whether an email address has been exposed in known data breaches. Our goal is to help people become aware of exposures so they can take preventive action. The service is provided "as is" and "as available," without guarantees of completeness, absolute accuracy, or uninterrupted availability.

Personal verification is free and requires no signup. For businesses, we offer paid services with additional features such as continuous monitoring, real-time alerts, and API integration, described on the For Business page.

3. Permitted Purpose

PassMonitor exists to help data breach victims. All use must be aligned with this purpose. You may use the service to check emails that belong to you or for which you have the owner's express authorization.

4. User Obligations

By using PassMonitor, you agree not to:

• Use the service for illegal, fraudulent, or unauthorized purposes
• Query third-party emails without the owner's authorization, with intent to harm, harass, or extort them
• Send automated mass requests (scraping, bots, crawlers) without prior written authorization
• Reverse engineer, decompile, or attempt to access internal systems, source code, or infrastructure of PassMonitor
• Redistribute, resell, or provide data obtained from the service to third parties without authorization
• Compromise the integrity, security, or availability of the service by any means
• Use the service in a way that could harm the reputation or interests of PassMonitor

5. Email Verification (OTP)

To protect user privacy, PassMonitor requires email ownership verification before displaying breach results. We send a unique verification code (OTP) to the provided address. This code is valid for 5 minutes and is single-use.

This mechanism ensures that only the email owner can access the exposure information associated with it. Any attempt to circumvent this mechanism is a violation of these terms.

6. Paid Services (Business)

PassMonitor's paid services grant the subscriber a non-exclusive, non-transferable, and revocable license to access additional features during the subscription period. Specific conditions, including usage limits and fees, are presented at the time of purchase.

PassMonitor may impose rate limiting to ensure service stability. Subscriptions auto-renew unless cancelled through the subscriber's dashboard. Cancellation does not generate a refund for the current period but maintains access until the end of the paid period.

7. Data Protection and Security

PassMonitor processes personal data in accordance with its Privacy Policy and applicable data protection laws. We do not store queried emails after verification, do not share personal information with third parties, and all communication is encrypted.

You are responsible for obtaining any necessary consents from third parties whose personal data you submit to the service, where applicable.

8. Limitation of Liability

PassMonitor is not liable for direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the service. Results are purely informational and do not constitute legal, technical, or security advice.

The service may not include all existing breaches. The accuracy and completeness of information are not guaranteed and may change without prior notice. We always recommend consulting a qualified professional for situations requiring specialized guidance.

9. Intellectual Property

All content, trademarks, logos, source code, design, and other materials of PassMonitor are the exclusive property of Codecortex Tecnologia. No intellectual property rights are transferred to the user through use of the service. Reproduction, distribution, or modification of any material without prior written authorization is prohibited.

10. Indemnification

You agree to indemnify and hold harmless PassMonitor and Codecortex Tecnologia from any losses, damages, costs, or expenses (including legal fees) arising from misuse of the service, violation of these terms, or third-party claims related to your actions.

11. Suspension and Termination

PassMonitor reserves the right to suspend or terminate access for any user who violates these terms, without prior notice. In cases of serious violation, access may be terminated immediately. Termination does not affect existing obligations or accrued rights of either party.

12. Changes to Terms

We reserve the right to modify these terms at any time. Significant changes will be communicated through the website with reasonable advance notice. The "Last updated" date at the top of this page will be updated whenever modifications are made. Continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of Brazil. Any dispute shall be submitted to the courts of São Paulo, SP, Brazil, to the exclusion of any other jurisdiction.
